Seven International Arbitration Institutions Signed Harbin Declaration

CIETAC hosted an international commercial arbitration conference on October 28, 2005 in Harbin. CIETAC counterparts from Russia, Mongolia, Japan, ROK, DPRK and Kazakhstan attended the one-day conference.

The conference was an enlargement of the previous annual conference among CIETAC, International Commercial Arbitration Court (ICAC) at the Chamber of Commerce and Industry of the Russian Federation and Mongolian National Arbitration Court of Mongolian National Chamber of Commerce and Industry. New members to the conference were The Japan Commercial Arbitration Association (JCAA), Korean Commercial Arbitration Board (KCAB), Korea International Trade Arbitration Committee (KITAC) and the newly founded Kazakhstani International Arbitrage (KIA).

The conference was a high-profile one. Among the participants were CIETAC Vice Chairman and Secretary General Dr. Wang Sheng Chang, ICAC Vice Chairman Professor Alexey Kostin, JCAA Director Mr. Masaharu Onuki, KCAB Director of International Arbitration Team Mr. Kim Kwang-Soo, KIA Chairman Prof. Maidan Suleimenov and KITAC Chairman Mr. Yun Son Ho and MNAC Secretary General Mrs. D. Altantsetseg.

The conference focused on two topics, namely latest development of international commercial arbitration in each jurisdiction being represented and institutional management of arbitral proceedings. Realizing that international commercial arbitration has increasingly become the preferred method for resolving transnational disputes, and that the past years have witnessed rapid development of cross-border trade and economic cooperation among the countries being represented and there is still huge potential for development in light of the emerging economic globalization, the participating institutions share the view that further cooperation among these institutions will not only advance cooperation of the countries being represented with regard to enforcement of arbitration agreements and awards, but also further encourage the regional economic cooperation and trade development among the countries being represented. The conference climaxed with the representatives signing the Harbin Declaration on Strengthening Cooperation in International Commercial Arbitration.

In the Declaration, the participating institutions agree to jointly advocate use of arbitration for resolving cross-border commercial disputes, especially those among business entities from the countries being represented. They also agree to offer convenience for conduct of arbitration in its own country by another participating institution whenever possible, to exchange information as to development of commercial arbitration in each jurisdiction and to provide channel for promoting other institutions where appropriate. Finally, these institutions agree to regularize the conference among them and to expand the sphere of the conference when necessary.

The seven institutions also agreed that the conference next year is to be hosted by Kazakhstani International Arbitrage (KIA).
